Abstract
This paper considers two problems in Lucretius' account of the origin of justice: its assumption of an apparently un-Epicurean absolute notion of fairness, and its unexplained assertion that the earliest humans were at risk of catastrophic extinction. It is argued that modern evolutionary theory and game-theoretic models help to solve these problems.
